Destination of severance payments purchase of new or used housing

1. Form for the withdrawal of severance payments.
2. Promise of sale.
3. Letter from the employer authorising the withdrawal of severance pay.
4. Promise of sale (with authenticated signatures of both parties).
5. Certificate of freedom and tradition, no more than 30 days old.
6. Photocopy of the identity card of the employee and seller.

Construction or improvement of housing

1. Form for the withdrawal of severance payments.
2. Letter from the employer authorising the withdrawal of severance pay.
3. Civil works contract under which the dwelling is to be built or remodelled.
4. 3 quotations.
5. Certificate of freedom and tradition, no more than 30 days old.
6. Photocopy of the employee’s identity card.
7. Statement certificate or balance certificate depending on the fund concerned.

The employer:

• It is not obliged to verify the authenticity of the documents presented by the worker, as it presumes good faith.

• He may not be penalised for not verifying the use of severance pay by the employee.

• However, the consequences of Article 254 of the CST may be applied if he/she makes partial payments or authorises the withdrawal of severance pay without the worker previously presenting documents proving that it will be invested in housing.
